Agreement to Terms

By accessing or using the TerraFuture website (terrafuture.org), including our environmental data dashboard, program information, donation portal, and all associated pages and services (collectively, the "Site"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Site.

TerraFuture Inc. ("TerraFuture," "we," "us," or "our") reserves the right to modify these Terms of Use at any time. Changes become effective upon posting to the Site. Your continued use of the Site after changes are posted constitutes acceptance of the revised terms. We encourage you to review these terms periodically.

Use of the Site

Permitted Use

The TerraFuture website is provided for informational, educational, and community engagement purposes. You may use the Site to:

• Learn about TerraFuture's programs, mission, and impact
• Access environmental data published on our open data dashboard
• Make donations to support TerraFuture's mission
• Register for events, volunteer opportunities, and programs
• Contact TerraFuture staff and submit inquiries
• Download materials made available for public use, such as press kit assets and data visualizations

Prohibited Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable local, state, national, or international law
• Attempt to gain unauthorized access to any portion of the Site, other accounts, computer systems, or networks connected to the Site
• Use automated tools (bots, scrapers, crawlers) to collect data from the Site without written permission, except for search engine indexing
• Interfere with or disrupt the Site's operation, servers, or networks
• Upload or transmit viruses, malware, or other harmful code
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Use the Site to transmit unsolicited commercial messages (spam)
• Reproduce, distribute, or create derivative works from Site content except as expressly permitted in these terms or by applicable open data licenses

Environmental Data and Open Data Dashboard

TerraFuture publishes environmental monitoring data on our open data dashboard. This data is made available under the Creative Commons Attribution 4.0 International License (CC BY 4.0), unless otherwise noted. Under this license, you are free to:

• Share: Copy and redistribute the data in any medium or format
• Adapt: Remix, transform, and build upon the data for any purpose, including commercial use

Subject to the following conditions:

• Attribution: You must give appropriate credit to TerraFuture, provide a link to the license, and indicate if changes were made. Suggested citation format: "Data: TerraFuture Environmental Monitoring, [year]. terrafuture.org/data."
• No additional restrictions: You may not apply legal terms or technological measures that restrict others from using the data as the license permits.

Environmental data is provided for informational purposes and is collected using standardized but community-scale methods. While we strive for accuracy, TerraFuture does not guarantee that data is error-free and does not warrant its suitability for any specific purpose, including regulatory compliance, legal proceedings, or professional environmental assessments.

Intellectual Property

TerraFuture Content

Unless otherwise indicated, all content on the Site, including text, graphics, logos, images, photographs, videos, software, and the design and arrangement thereof, is the property of TerraFuture Inc. or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may view, download, and print pages from the Site for personal, non-commercial use, provided that you do not modify the content and that you retain all copyright and proprietary notices.

Trademarks

"TerraFuture," the TerraFuture logo, and "Building resilient communities for a sustainable tomorrow" are trademarks of TerraFuture Inc. Use of TerraFuture trademarks requires prior written permission, except for fair use references in news reporting, academic citation, or similar contexts.

User Submissions

If you submit content to TerraFuture through the Site, including comments, testimonials, photographs, or other materials, you grant TerraFuture a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, display, and distribute such content in connection with TerraFuture's mission and operations. You represent that you own or have the necessary rights to submit such content and that it does not infringe any third-party rights.

Donations

Donations made through the Site are processed by our third-party payment processor. TerraFuture does not store credit card information on our servers. All donations are final and non-refundable unless made in error, in which case you may contact development@terrafuture.org within 30 days for a refund.

TerraFuture is a registered 501(c)(3) nonprofit organization (EIN: 84-3291056). Donations are tax-deductible to the extent permitted by law. Tax receipts are issued for all donations of $50 or more.

Third-Party Links

The Site may contain links to third-party websites, including partner organizations, news publications, and government agencies. These links are provided for convenience and informational purposes. TerraFuture does not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party websites. Accessing third-party sites is at your own risk.

Environmental data, program descriptions, and other informational content are provided for general knowledge and community engagement purposes. They do not constitute professional environmental, legal, financial, or health advice.

Limitation of Liability

To the fullest extent permitted by applicable law, TerraFuture, its directors, officers, employees, volunteers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Site, including but not limited to damages for loss of data, profits, goodwill, or other intangible losses, even if TerraFuture has been advised of the possibility of such damages.

TerraFuture's total liability for any claim arising out of or related to these Terms of Use or the Site shall not exceed the amount you paid to TerraFuture, if any, during the twelve months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless TerraFuture, its directors, officers, employees, volunteers, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or related to your use of the Site, your violation of these Terms of Use, or your violation of any rights of a third party.

Governing Law

These Terms of Use are governed by and construed in accordance with the laws of the State in which TerraFuture is incorporated, without regard to its conflict of law provisions. Any dispute arising from these terms or your use of the Site shall be resolved in the courts located in Metro City.

Severability

If any provision of these Terms of Use is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
